Suspension and Termination

At UPUN, we aim to maintain a safe, creative, and respectful environment for all users. To ensure compliance with our platform’s standards, we reserve the right to suspend or terminate accounts for violations of our Terms of Service or Community Guidelines. This policy outlines the conditions, process, and consequences of account suspension or termination, as well as the appeal process for users.

Grounds for Suspension or Termination

An account may be suspended or terminated by an Admin under the following conditions:

• Repeated Violations: Multiple breaches of the Terms of Service or Community Guidelines, even after warnings or penalties.

• Severe Violations: A single serious violation of any policy, including but not limited to harassment, hate speech, abuse of intellectual property rights, or illegal activities.

• Eligibility for Termination: If a user commits a violation that warrants termination but has not been previously suspended, a suspension may be applied first. However, users can only be suspended once; subsequent violations lead to termination.

Suspension Details

• Duration: Suspensions are temporary and last between 30 to 90 days, depending on the severity of the violation.

• Login Restrictions: Suspended users are unable to log in or access their accounts during the suspension period. All login attempts will be denied.

• Profile Visibility: During suspension, a user’s profile remains visible unless it was set to private before the suspension. Subscriptions tied to public profiles, such as vanity badges (e.g., verification marks), will remain active and recur as usual.

• Single Suspension Rule: Users may only be suspended once. A second suspension is escalated to permanent termination.

• Notification: Users will receive an email notification detailing the reason for their suspension, its duration, and any relevant actions required for reinstatement.

• Reinstatement: Upon the expiration of the suspension, the account will be reinstated automatically, and the user can resume activity on the platform.

Termination Details

• Permanent Action: Terminations are permanent. Users whose accounts are terminated cannot access or recover their accounts, content, or any associated data.

• Profile Visibility: Upon termination, the user’s profile is immediately set to private, and all active subscriptions are halted.

• Data Removal: Once an account is terminated, all associated data, including Creations, Products, and Group activity, will be permanently removed from UPUN within 30 days of the termination date. Users may appeal the termination during this period.

• Notification: Terminated users will be notified via email, detailing the reasons for termination and the steps to appeal the decision if applicable.

Appeal a Decision

Users have the right to appeal both suspensions and terminations. Here’s how:

• Suspension Appeals: Users may submit an appeal within 7 days of the suspension notice. The appeal should provide reasons for contesting the suspension, along with any relevant evidence. The Admin team will review the appeal and respond within 14 days.

• Termination Appeals: Users may appeal terminations within 30 days of receiving the termination notice. During this period, the Admin team will review the case and respond within 30 days.

• Finality of Appeals: Once an appeal decision has been made, no further appeals can be filed. If the appeal is denied, the suspension will remain in effect, or the account will be permanently terminated after 30 days.

Reinstatement Conditions

• For Suspended Accounts: Suspended accounts will be automatically reinstated after the suspension period ends, provided there are no further violations. Any warnings or penalties issued during the suspension remain in place.

• For Terminated Accounts: If an appeal for termination is successful, the account may be reinstated, but additional conditions may apply (e.g., removal of offending content or agreement to abide by stricter terms).

• Repeat Offenses: Repeated violations following reinstatement, especially after a suspension, will result in immediate termination of the account.

Consequences of Permanent Termination

• Loss of Access: Once an account is terminated, the user loses all access to the platform, including their profile, Creations, Products, Groups, and any active subscriptions or content they’ve engaged with.

• Data and Content Removal: Terminated accounts, along with all associated data and content, will be permanently deleted from the platform within 30 days of termination.

• No Reapplication: Users whose accounts are terminated cannot reapply for a new account or create another account under a different identity. Doing so will result in the account being terminated without notice.

Preventive Measures and Education

To prevent suspension or termination, users are encouraged to:

• Follow the Community Guidelines and respect the intellectual property rights of others.

• Avoid engaging in abusive behavior, harassment, spamming, or other disruptive activities.

• Familiarize themselves with UPUN’s policies on content creation, virtual currency, and group participation to avoid unintentional violations.
