Creations: All Rights Reserved License

Players on UPUN have the option to apply an All Rights Reserved license to their Creations to protect their original content from unauthorized use or distribution. This policy outlines how the All Rights Reserved license functions on UPUN and the responsibilities Players have when applying this license.

Purpose of the All Rights Reserved License

An All Rights Reserved license designates that the Creator holds full rights to the content within their Creation. This license governs the use, distribution, reproduction, and modification of the Creation and its contents. It serves as a testament that the Player claims ownership of the content and wishes to restrict its use by others.

Applying the License

When a Player applies the All Rights Reserved license to their Creation, they are asserting that:

• The Player is the rightful owner of the content and holds the necessary rights to claim ownership.

• The Player controls how the content is used, shared, or modified by others, with all permissions being explicitly granted by the owner.

However, applying this license does not automatically guarantee that the content is fully protected under the law. UPUN cross-references the Player’s ownership claim with other data points to ensure the content lawfully belongs to the Player. If conflicting ownership is found or reported, the content may be subject to review and potential penalties.

Copyright Infringement and Duplicate Content

If multiple Creations contain similar or identical content, they may be subject to copyright infringement review under the following circumstances:

• All Rights Reserved Conflict: If one or more of the Creations have an All Rights Reserved license applied, any unauthorized duplicates will be subject to review.

• Report of Infringement: The original rights holder may report duplicate Creations and provide evidence to justify the claim of infringement. UPUN will investigate and take appropriate action, which may include removal of the duplicate content or penalties against the infringer.

• Creative Commons Conflicts: If multiple Creations contain conflicting licenses, such as Creative Commons licenses with different properties, this may result in a review and potential resolution in favor of the rightful owner.

Potential Spam Policy Violations

In cases where multiple Creations with similar or identical content exist without legitimate licensing conflicts, they may still violate UPUN’s Spam Policy. However, certain exceptions apply:

• Creative Commons Derivative and Non-Commercial Licenses: If a Creation is licensed under Creative Commons with “Derivative” and “Non-Commercial” properties, it may be exempt from duplication penalties.

• Linked Accounts: If the Player’s account is linked to the original owner of the content being copied, the duplicate content may be allowed.
