Creations: Creative Commons License

UPUN offers Players the ability to apply Creative Commons licenses to their Creations, enabling greater flexibility in how content can be shared, reused, and adapted by others. By using Creative Commons licenses, Players can promote collaboration while maintaining control over how their work is used. Each Creative Commons license is defined by specific properties, which set the terms for the content’s use.

Creative Commons License Properties

When applying a Creative Commons license to a Creation, Players may choose from the following properties to further define how their content is used:

• Attribution (BY): Allows others to copy, distribute, display, and perform the copyrighted work, provided that the original creator or copyright holder is credited for their work. Attribution is a core requirement in all Creative Commons licenses.

• Non-Commercial (NC): Permits others to distribute, display, and perform the work (including derivative works) for non-commercial purposes only. Any commercial use of the content is prohibited under this license.

• Non-Derivative (ND): Allows others to copy, distribute, display, and perform only verbatim copies of the work. Creating derivative works, such as modifications or adaptations, is not permitted.

• Share Alike (SA): Permits others to distribute derivative works, but only under a license that is identical to the license governing the original work. This ensures that any adaptations of the work remain freely available under the same terms.

Choosing the Right License for Your Creation

Players applying a Creative Commons license to their Creation must carefully consider which properties best suit their intentions. Each license combination provides a different level of flexibility for content use:

• Attribution (BY): The most flexible license, allowing for wide distribution and use, as long as proper credit is given.

• Attribution + Non-Commercial (BY-NC): Allows non-commercial use with credit, but prohibits any commercial exploitation.

• Attribution + Share Alike (BY-SA): Encourages sharing under the same terms, allowing derivative works with credit, but ensuring they remain under the same license.

• Attribution + Non-Derivative (BY-ND): Provides the strictest terms, allowing distribution only in its original form without modifications.

Legal Implications of Creative Commons Licenses

Applying a Creative Commons license to a Creation on UPUN does not remove the Creator’s ownership of the content. Instead, it defines how others can interact with the content, subject to the chosen license properties. UPUN will review any potential license violations and take appropriate action if content is used outside the bounds of the license.

• Infringement: Creations that violate a Creative Commons license may result in penalties, removal of content, or suspension of the infringing Player’s account.

• Attribution Violations: Failing to credit the original creator when required by the license can lead to content removal and penalties.

• Non-Commercial Violations: Using a Creation licensed under Non-Commercial (NC) terms for commercial purposes is prohibited and will result in disciplinary action.

Multiple Creations and License Conflicts

In cases where multiple Creations have identical or similar content, conflicting Creative Commons licenses may lead to review for potential copyright infringement. UPUN will assess whether the content is being misused based on the applied licenses and take appropriate action to resolve the conflict.

Reporting License Violations

If a Player believes their Creative Commons license has been violated, they can file a report through the Report feature. UPUN will investigate and address the issue, including removing infringing content or applying penalties to the offending Player.
