DMCA and Copyright Infringement

Copyright refers to the legal protection granted to the owner of intellectual property (IP), giving them exclusive rights to copy, distribute, perform, and create derivative works of their material for a limited period. UPUN recognizes the rights of copyright owners and will act on any valid requests concerning infringing materials.

• UPUN supports the rights of creators and owners concerning intellectual property and trademarks.

• Using copyrighted materials without proper authorization or infringing on IP rights may lead to penalties, including modification, removal of content, or penalization of the offending Player's account.

• Creations or Products found to contain copyrighted material, either through a report or a Mod/Admin review, will be unpublished and result in a Copyright Penalty.

• Groups that contain copyrighted materials within their catalogs will be dissolved.

• The Copyright Penalty is a permanent penalty that can only be applied or removed by a Mod or Admin. It prevents the Player from receiving rewards linked to the infringing content.

• The Copystrike Penalty is an incremental violation penalty, applied to a Player's Account for each instance of a Copyright Penalty applied to a Material (or for each batch of penalties applied at once):

  • Copystrike I: A warning.

  • Copystrike II: Occurs upon a second offense within 90 days, resetting the expiration of the penalty.

  • Copystrike III: May result in the suspension or termination of the Player's account.

• Copystrike penalties expire after 90 days if no further infringements occur. Penalties will increment upon further violations within this period, resetting the expiry and decrementing after expiration.

To report misuse or infringement of copyrighted material, you can:

• Use the Report feature within the app.

• Contact our DMCA team directly via email. Having a Player account linked to the report is strongly encouraged for quicker resolution.
